All copyrights, trademarks and any other intellectual property relating to materials or the content of our services belong, without limitation, to SINOVO health solutions GmbH or our (licensing) partners. You may not copy, reproduce, transmit, distribute, modify or make commercially viable these materials or content without the written permission of SINOVO health solutions GmbH or our (licensing) partners.

By submitting materials to our services, we and our (licensing) partners are entitled to the non-exclusive usage rights, which are permanently exempt from fees, within our services and otherwise. 4. Illegal use of the contents

B. Access and use of the services of mylife™ Software online version and use of the mylife™ App of SINOVO health solutions GmbH

1. General information

a) In order to use the services of mylife™ Software online version or the mylife™ App of SINOVO health solutions GmbH an Internet connection is required. The user is solely responsible for the use of the necessary hardware. Any connection or transmission costs resulting from its use are to be borne by the user. For the use of the mylife™ App, a mobile terminal that meets certain system requirements is also required. SINOVO health solutions GmbH is not responsible for ensuring compliance with the system requirements. This is the sole responsibility of the user.

The user is solely responsible for the accuracy of the login information and the information transmitted to SINOVO health solutions GmbH as part of the registration process.

Likewise, the user is responsible for maintaining the confidentiality of his/her access data including the password. It is not permitted to transmit or make accessible to third parties the login data or the password. If access to the mylife™ App requires the registration of the user, the user is responsible for ensuring that his/her password is not accessible to third parties. The user assumes responsibility for all actions that are carried out using his/her access data.

Moreover, the user is required to immediately inform SINOVO health solutions GmbH in the event of any unauthorised use of login and the password or in the event of any irregularities affecting security.

No harassing, libellous, racist, discriminating, violent, obscene, pornographic or threatening content or any other unlawful content may be transmitted through the services of the mylife™ Software online version and SINOVO health solutions GmbH

Furthermore, the mylife™ Software and all the services of SINOVO health solutions GmbH may not be used in a manner that can lead to cancellation, damage or reduced performance and violates the rights of third parties. They also include the right to intellectual property, the right to confidentiality and data protection provisions.

Advisory services such as the hotline of SINOVO health solutions GmbH or the central telephone number are offers which can be reached by means of the contact details listed. The advisory service cannot replace individual diagnoses, treatments, or treatment recommendations, but can only provide general and abstract health information that does not relate to any particular patient. The users of the advisory service are obliged to consult their doctor regarding their individual diagnosis and treatment and to coordinate all measures related to their health with this doctor.

SINOVO health solutions GmbH reserves the right to store the information regarding the calls in the form of call notes. Calls of a fraudulent nature, calls made with bad intent or with the intention of committing fraud may have legal consequences.

b) SINOVO health solutions GmbH provides all its services in connection with the service of mylife™ Software online version or the mylife™ App to users, doctors, patients or persons of trust (hereinafter referred to as "Customer") solely on the basis of these General Terms of Use and Terms and Conditions (GTCs). Other terms and conditions apply only insofar as this has been confirmed individually by SINOVO health solutions GmbH. SINOVO health solutions GmbH is entitled to amend or supplement these GTCs after giving a reasonable period of notice. The announcement will be made by e-mail by sending the changed GTCs or by e-mail with a reference to the chance to view the changed GTCs on the Internet on the web pages of SINOVO health solutions GmbH at https://mylife-software.net/terms. If the Customer does not object to the amended or supplemented conditions within six weeks of their publication on the Internet, the amended or supplemented terms shall become effective. If the Customer objects within the time period, both contractual partners are entitled to terminate the contract at the time when the amended or supplemented GTCs enter into force.

2. Type and execution of services by SINOVO health solutions GmbH

a) The performance of SINOVO health solutions GmbH includes the provision of the mylife™ Software online version, the provision of the mylife™ App, an online data management system and diabetic diary for the customers, by means of which patients' diabetes values (e.g. blood glucose levels, blood pressure readings or insulin pump readings) can be recorded, managed and viewed from any location.

b) With the provision of the mylife™ Software or the mylife™ App, SINOVO health solutions GmbH does not undertake any medical work, does not give any therapeutic advice and does not provide services that can or should replace the tasks performed by a doctor.

c) The activation of access to the mylife™ Software online version shall take place after the contract has been concluded with the Customer.

d) Insofar as SINOVO health solutions GmbH provides voluntary services and performances beyond the contractual services specified in clause 2a), it may change or discontinue these services on account of technical, legal or economic changes in the general framework conditions or considerations or continue to offer services that have until now been free of charge for a fee in the future.

SINOVO health solutions GmbH will inform the Customer at once if the further provision of voluntary, unpaid services is jeopardized on account of the aforementioned reasons. SINOVO health solutions GmbH will take into account the interests of the Customer when assessing the period of adjustment or modification or the compensation of these services.

The Customer has the right to extraordinary termination within 14 days of the notification of the termination, modification or compensation of the voluntary services. Further rights of the Customer in connection with the cessation, modification or compensation of voluntary services are excluded.

3. Server availability, security

a) Server failures due to force majeure and events beyond the control of SINOVO health solutions GmbH, which make its services considerably more difficult or impossible to provide – in particular strikes, lock-outs, official directives, disturbances in the area of Telekom's services or on the Internet, excessive use by other users, attacks by hackers and/or "spammers", etc. – entitle the Customer to a reduction in compensation only if the impediment is significant and persists for a significant period of time. The Customer is then entitled to a corresponding reduction in his/her current monthly fees and charges until the next termination date.

If the impediment exceeds an insignificant period of time and if the Customer is thus unable to continue the contract until the next termination date, he/she has the right to terminate the contract extraordinarily and without giving notice. Termination must be preceded by a threat of termination by setting an appropriate deadline for the removal of the ground for termination. The Customer is not entitled to any further rights, except in the case of intent, gross negligence or the violation of an essential contractual obligation of SINOVO health solutions GmbH.

b) The data available in mylife™ Software online version can only be retrieved by using the user ID and password (access data). The Customer undertakes to keep these access data strictly confidential and to inform SINOVO health solutions GmbH at once as soon as he/she becomes aware that the access data are wholly or partially known to third parties. Should, on account of a fault of the Customer, third parties influence the data stored data through misuse of the access data, which also includes, among other things, their modification, deletion, download and forwarding, SINOVO health solutions GmbH assumes no liability for this. SINOVO health solutions GmbH is, in this case, entitled to block the user account and to give the Customer a new password. Any reasonable costs resulting from this are to be borne by the Customer.

c) SINOVO health solutions GmbH herby expressly points out that protection for data transmissions in open networks, such as the Internet, cannot be comprehensively guaranteed in accordance with the current state of the art. The data stored on the servers of SINOVO health solutions GmbH may, from a technical point of view, also be viewed and changed by other Internet users without authorisation. SINOVO health solutions GmbH has secured its servers against unauthorised access using proven and customary systems. Any liability of SINOVO health solutions GmbH for any interference in the data stored, which takes place despite the functionality of the system backups provided by SINOVO health solutions GmbH, is excluded.

d) The Customer is obliged to carry out a data backup on his/her own storage media (hard disk, floppy disk or similar) in the event of any changes to the data stock. In particular, the health-relevant data entered into "mylife™ Software Online Version" must also be secured on the Customer's own storage media. The Customer is required, within the limits of his/her knowledge and abilities, to test software before using it in order to check that it is free of defects and that it can be used in the specific situation before commencing with the operational use of the program. This also applies to programs that the Customer receives from SINOVO health solutions GmbH. If there is any doubt, the Customer should contact the technical support team of SINOVO health solutions GmbH +49 6109-500 3909 / info@sinovo.de. The Customer is hereby expressly advised that even minor changes to the software can affect the operability and usability of the entire system.

e) SINOVO health solutions GmbH does not guarantee that the mylife™ App or the contents conveyed thereon are compatible with the hardware and software of the Customer's mobile device.

4. Contract conclusion, contract termination

a) The contract with SINOVO health solutions GmbH is concluded by the completion and submission of the online form at https://mylife-software.net/register by the Customer upon its receipt by SINOVO health solutions GmbH.

b) The contract is concluded for an indefinite period of time. The contractual relationship can be terminated by both parties without giving any reasons and with a notice period of 30 days to the end of the month.

c) The right to extraordinary termination for good cause remains unaffected.

d) Each termination must be in writing for it to be effective; this is also ensured by sending an e-mail.

e) The participation of doctors requires them to be registered a doctor and such registration to be verifiable.

5. Liability

Insofar as these GTCs do not contain any special provisions, the liability of SINOVO health solutions GmbH is regulated as follows:

a) SINOVO health solutions GmbH shall not be liable for any damage resulting from errors, delays or interruptions in transmission, faults in the technical equipment, incomplete data, viruses or from any other way when the mylife™ App is used, unless such damage is a result of intent and gross negligence.

b) SINOVO health solutions GmbH shall only be liable for damage if SINOVO health solutions GmbH or one of its vicarious agents has violated a material contractual obligation (cardinal obligation) or the damage is due to the gross negligence or intent of SINOVO health solutions GmbH or one of its employees or vicarious agents. The liability of SINOVO health solutions GmbH for damage to life, limb or health as well as for guarantees remains unaffected.

c) The liability of SINOVO health solutions GmbH is, in the cases of Point 5 b) limited to the damage suffered by the Customer, which was reasonably foreseeable for SINOVO health solutions GmbH upon conclusion of the contract.

6. Remuneration

a) If a fee is agreed, it will fall due 14 days after the invoice has been issued. SINOVO health solutions GmbH may, in the event of a delay in payment, postpone any further processing of the current order at its discretion until payment has been made or demand payments in advance.

b) Unless otherwise agreed, the respective price list of SINOVO health solutions GmbH shall apply; it can be accessed via https://mylife-software.net/tariff.

7. Right of revocation

Right of revocation

You have the right to revoke this contract within fourteen days without having to give a reason for doing so. The revocation period is fourteen (14) days from the date of contract conclusion, but not before you have received this information in writing and not before you have been informed by us in accordance with the requirements of Article 246a(1)2 sentence 1 number 1 EGBGB (Introductory Act to the German Civil Code). In order to exercise your right of revocation, you must send a clear statement (e.g. in the form of a letter by mail, fax or e-mail) to us - SINOVO health solutions GmbH, Willy-Brandt-Straße 4, 61118 Bad Vilbel, phone number 06172-3986-90, fax number 069-3986-91, e-mail address info@sinovo.net, confirming that you are revoking the contract. In order to comply with the revocation period, it is sufficient for you to send the notification of your exercise of the right of revocation before the revocation period expires. If you wish to make an announcement, see also Appendix 1 (at the end of this document).

8. Consequences of the revocation

If you withdraw from this contract, we shall reimburse you immediately for any payments we have received from you since contract conclusion, at the latest within fourteen days as of the date on which we received the notification of your cancellation of this contract. In order to effect this reimbursement, we will use the same means of payment as you used in the original transaction, unless expressly agreed otherwise with you. You will not be charged any fees with regard to this reimbursement.

9. Final provisions

a) Oral subsidiary agreements do not exist at the time the contract was concluded.

b) The law of the Federal Republic of Germany applies, excluding the UN Sales Convention. The place of performance and court of jurisdiction for all disputes arising out of and in connection with this contract is, with regard to contracts with merchants, the registered office of SINOVO health solutions GmbH.

c) SINOVO health solutions GmbH hereby points out that, in addition to the ordinary legal process, you also have the option of settling disputes out of court in accordance with Regulation (EU) No. 524/2013. Details can be found in Regulation (EU) No 524/2013 and at the following Internet address: https://eur-lex.europa.eu/legal-content/DE/ALL/?uri=CELEX%3A32013R0524. SINOVO health solutions GmbH is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

This Privacy Policy (“Policy”) explains how Ypsomed Diabetes Care AG and its affiliates, subsidiaries, and related companies (“Ypsomed”, “our”, “us,” or “we”), collect, use, share, transfer and process personal data collected from or about you with regards to mylife Diabetescare. The collection and processing of personal data depends on the registration and use of the mylife App, the mylife Software (PC), the mylife Cloud, the mylife CamAPS FX App, as well as the connection with other devices and systems.

The mylife Diabetescare therapy management ecosystem supports the diabetes therapy management for healthcare providers and patients, which is why sensitive personal data (health data) is always processed. In order to use mylife Diabetescare therapy management, you must provide Ypsomed with your explicit consent to the processing of personal data relating to your health.

We process your personal data on the basis of your consent for the following purposes:

· Account Creation & Diabetes Management: Processing health-related data when creating a mylife Diabetescare Therapy Management System account to support your diabetes treatment or the treatment of someone you care for, such as your child.

Customer Service Requests: Handling health-related data when you contact our customer service for inquiries regarding the mylife product family, therapy management, or services. This may include resolving performance issues or sharing data with third-party processors to address your service request.
Diagnostic & Troubleshooting Assistance: Processing diagnostic and troubleshooting data, including health-related information, to diagnose and resolve performance issues related to your service request.
Data Transfer to Healthcare Providers: Transferring your personal data, including health data, to your healthcare provider or to their electronic patient record systems as part of your treatment.
Third-Party Data Transfers: Sharing your health-related data with third-party systems and tools, where necessary, to provide or enhance services.
Service Provision & Improvement: Processing your data to provide, maintain, improve, and develop the functions and content of the mylife Diabetescare therapy management system, ensuring it meets your needs.

In addition to these purposes, we may request your separate consent to process your personal data (including health data) for the following purposes:

Cookies & Log Data for Analytics: Using cookies to collect anonymised log data (e.g., IP address, date, time, device data) for statistical evaluations and website performance monitoring, without creating user profiles or linking the data back to you personally.
Marketing Communications, Personalised Services & Engagement: We may request your consent to send you marketing materials relevant to you, including content tailored to the specific pumps and devices you use. This may involve analysing certain health-related information, such as the type of diabetes you have, to ensure that our communications and services are personalised and meaningful. We may also combine your personal data with other information we hold about you to better understand your preferences and improve our interactions with you. Invitations to Market Research, Product Testing & User Insights: With your consent, we may invite you to participate in surveys, market research, clinical trials, and product testing activities (such as A/B testing). Your participation helps us improve our products and services. Your actual participation will require an additional explicit consent including all relevant information on a case-by-case basis, and you are of course free to decline at any time.
Use of Health Data for Research, Regulatory Compliance, Product Development & User Insights: We may seek your consent to use your health data for research, regulatory compliance and product development & User Insights, helping us enhance our technologies and create better solutions for you and others living with diabetes. Your data might be shared with external companies and organisations for these purposes.
Anonymisation, Synthesisation & Further Data Use: With your permission, we would anonymise your personal data, which means it cannot be traced back to you, and use such anonymised data for research, regulatory compliance, product development & user insights, as well as data synthesis. Synthesisation involves creating new, artificial datasets based on patterns in the original data.

You can revoke your consent at any time by contacting us directly at via our customer care in Section 9. Please note that if you withdraw your consent, it may no longer be possible to use the mylife Diabetescare therapy management system or certain Ypsomed services and products, since the processing of health-related data is essential for their functionality.

We may also process your personal data, including health-related data, when necessary for the exercise or defence of legal claims. This includes:

Error Detection & Troubleshooting: Analysing log files to detect and resolve errors, such as faulty links or program issues, and diagnosing service performance concerns.
Fraud & Security Monitoring: Processing log files to detect and prevent fraudulent, abusive, or prohibited activities and to ensure the protection and security of our services. We may review log files (including IP addresses) in cases where there is a suspicion of misuse or violations of law or contract.

In addition, to the extent permitted by law, we may need to process your personal data to comply with legal obligations, such as:

Traceability of Medical Devices: Ensuring the traceability of medical devices from the manufacturer to the end user for purposes such as product information, safety instructions, or recalls.
Technical Training: Providing technical training in the proper handling of our medical devices.
Data Transmission to Health Insurance Providers: Transmitting necessary data to statutory health insurance providers for compliance and reimbursement purposes.
Post-Market Surveillance & Quality Assurance: Ensuring high standards of quality and safety of medical devices post-market, including monitoring and improving the performance, safety, and effectiveness of medical devices. This may also involve repairing or enhancing mylife Diabetescare therapy management systems and meeting regulatory requirements related to post-market surveillance.

3. Use of the mylife Diabetescare Therapy Management

3.1 Manufacturer of the mylife Diabetescare Therapy Management

The mylife Diabetescare therapy management was developed on behalf of Ypsomed AG by SINOVO health solutions GmbH (SINOVO). Use of the mylife App, the mylife Software and the mylife Cloud is subject to SINOVO’s General Terms and Conditions of Business and Use.

SINOVO processes the personal data collected in the mylife Diabetescare therapy management on behalf of Ypsomed and exclusively as contractually agreed or as instructed by Ypsomed. Fulfilment of legal, regulatory or official obligations by SINOVO as the medical device manufacturer of mylife Diabetescare therapy management remains reserved.

3.2 The mylife App

When you download the mylife App to your smart device, you have the option of connecting your mylife YpsoPump to the mylife App. In addition, you can also link blood glucose meters and/or selected CGMs (glucose monitoring systems) from third-party providers to the mylife App.

· When linking blood glucose meters, no data are shared with third parties.

· If the Dexcom CGM is connected to the mylife App, the data generated by the CGM are shared with Dexcom. Linking the Dexcom CGM with the mylife App explicitly requires a Dexcom Clarity account and Dexcom's data protection provisions apply.

In the mylife App, you can choose whether and how you wish to synchronise your data with the mylife Software and/or mylife Cloud. If you do not activate synchronisation with the mylife Software and/or mylife Cloud, the data collected will only be stored on your smart device. No transfer to Ypsomed, SINOVO or third parties will take place. You do not need to register to use the mylife App.

The following data can be recorded in the mylife App and saved on your smart device:

· Blood glucose levels and/or sensor glucose values

· Boluses

· Basal rates

· Insulin on Board (IOB)

· Other data useful for therapy (e.g. carbohydrates)

If synchronisation of the data with the mylife Software and/or mylife Cloud is desired, the data protection provisions of the mylife Cloud (Section 3.4) or mylife Software (Section 3.3) additionally apply.

3.3 The mylife Software (PC)

You can either transfer the data from your mylife YpsoPump insulin pump or your blood glucose meter directly to the mylife Software or you can connect your devices to the mylife App and synchronise them with the mylife Software via the mylife Cloud.

The mylife Software is available with two different options. You can decide whether you wish to install the mylife Software as a PC-only version directly on your computer or use the mylife Software together with the mylife Cloud. This requires a data upload from the software to the cloud with the mylife Uploader. The conditions for using the mylife Cloud can be found in the sections that follow.

If you have agreed in the mylife App to synchronise your data with the local mylife Software on your computer, the following data, for example, will be transferred from your mylife App via mylife Cloud to the local mylife Software on your computer:

· Glucose values

· Boluses

· Basal rates

· Insulin on Board (IOB)

· Other data useful for therapy (e.g. carbohydrates)

If you connect your mylife YpsoPump insulin pump or blood glucose meter directly to the mylife Software without the mylife Cloud, the corresponding insulin and blood glucose data will be transferred from the devices to the mylife Software. In this case, the data in the local mylife software are stored exclusively on your device. No transfer to Ypsomed, SINOVO or any third party shall take place.

3.4 The mylife Cloud

To be able to use the mylife Cloud, you must register for the mylife Cloud via your mylife App or an internet browser. The mylife Cloud is an online service and is not installed locally on your device. The data is stored in country-specific fashion on Microsoft servers (Azure). Unless otherwise stated in Section 8 or Section 10, these are servers located in the EU.

Before you can register for the mylife Cloud, you must agree to SINOVO’s General Terms and Conditions of Business and Use and to the processing of your personal data in accordance with this Privacy Policy.

The following categories of personal data may be collected and transmitted during registration:

· Contact data (surname, given name, e-mail address, telephone number)

· Login data (e-mail, password)

· Account use (patient administration or self-administration)

· General settings (e.g. language, country, time zone)

For insulin therapy:

· Therapy details (type of diabetes, type of therapy, insulin, name of healthcare professional)

· Personal data (weight, height, gender, date of birth)

· Blood glucose ranges (target range, hyperglycaemia, hypoglycaemia, time of day, after meals)

· Device data (blood glucose levels, insulin release values, alarms and notifications from connected devices, status information from the devices)

· Therapy data (blood glucose levels, insulin doses, carbohydrate intake, sporting activities)

As soon as you log in to your mylife Cloud account, a cookie is placed on your device which can be used to identify you for the duration of your visit. The cookie expires automatically at the end of the session. You can save this cookie permanently using the “Log in automatically on this computer” function for an automatic login. The cookie then contains parts of your login data in encrypted form. However, an automatic login on two (2) different computers is not possible in this case.

4. The mylife CamAPS FX App

The mylife CamAPS FX App is an independent smartphone application of CamDiab Limited, with registered offices in Cambridge UK, business address Level 4, Institute of Metabolic Science, Box 289, Addenbrooke’s Hospital, Hills Rd, Cambridge, CB2 0QQ, United Kingdom (CamDiab).

To use the app, you must register separately. The CamDiab Terms of Use and Privacy Policy apply.

The mylife CamAPS FX App offers a function that permits the display of data from the app in the mylife Cloud. By logging into the mylife Cloud from the mylife CamAPS FX App, you consent to the transfer of data from CamDiab to Ypsomed and thereby activate this function. The following categories of personal data are then transmitted from the mylife CamAPS FX App to the mylife Cloud:

· Account data, for example

o E-mail address

· Device data and settings, such as, for example

o Type of terminal and operating system

o App version

o CGM brand and serial number

o Pump brand and serial number

o Error messages pump

· Therapy settings such as, for example

o Unit of glucose calculation (mg/dL or mmol/L))

o Insulin-to-carbohydrate ratio

o BG target value

o Auto-mode target value

· Health data such as, for example

o CGM values

o BG values

o Basal insulin

o Boluses

o Meals

o Alarms

o Auto-mode status

5. Sharing Data of the mylife Diabetescare Therapy Management with Others

mylife Diabetescare therapy management offers various options by which patients may share their data with their medical professionals or other people.

5.1 Transferring Data from the Insulin Pump or Blood Glucose Meter to the mylife Software

Medical professionals can install the mylife Software in the patient management version. During a consultation with the physician, they can connect the patients’ mylife YpsoPump insulin pump or blood glucose meter directly to the mylife Software installed on their computer and import the data.

If the medical professional only uses the local mylife Software, the data remain stored on the medical professional’s computer. In this case, no data are transferred between the medical professional and the patient or vice versa and neither Ypsomed nor SINOVO can access these data.

Note: the medical professional is responsible for the processing of these data. Ask your medical professional how they process and protect your personal data and how you can exercise your rights listed below vis-à-vis the medical professional.

Clarify in advance with your medical professional whether she or he will synchronise the data from the mylife Software with the mylife Cloud. Inform the medical professional if you do not agree to such a synchronisation.

5.2 Sharing Reports from mylife Diabetescare Therapy Management

In the mylife App or mylife Cloud menu, you can find the “Report” function, which allows you to create a PDF report or CSV export of the data for a time frame of your choice. Among other things, the report may include the following data:

- glucose and insulin data

- the pump and bolus suggestion calculator settings as well as

- various displays of the therapy data.

- The diary of the mylife App or Cloud (CSV export)

You can forward the report to your medical professional or your clinic by means of channels which permit the transmission of PDF and CSV files. Please note that the PDF and CSV reports contain health data. You should therefore choose a secure channel for transmission and enquire about the data protection information stored there. Transmission of the report is at your own risk and responsibility.

5.3 mylife Cloud - Data Synchronisation between Patients and the Medical Professional

The mylife Cloud simplifies data synchronisation between medical professionals and their patients. Medical professionals can invite their patients to synchronise their data directly between the two mylife Cloud accounts.

As a patient, you consent to your data being shared with the medical professional in the “Data release” section of your patient account. Once the data release has been activated, the medical professional can access and analyse your data in her or his patient management account.

You can revoke your consent for data release at any time in your mylife Cloud account. From the moment of revocation, the medical professionals no longer have access to your data. However, a copy of your data that has been shared up to this point in time will remain in the medical professional’s account. The medical professional is responsible for these data and is therefore the addressee for the assertion of your rights.

5.4 Connecting the mylife Cloud with Clouds from Other Providers

You can link your mylife Cloud with therapy clouds from other providers (third-party providers) and have certain predefined data transferred to the cloud of the third-party provider with your consent. In this case, the data are transferred unilaterally from the mylife Cloud to the cloud of the third-party provider.

Next, select the login for the mylife Cloud in the third-party provider’s system, if intended. You will be redirected to the login for the mylife Cloud, where you must log in correctly with your mylife Cloud security elements. With this login you agree to the transfer of data to the third-party provider. You can transfer your data to several clouds from third-party providers who permit a connection to the mylife Cloud.

The third-party provider’s data protection provisions apply to the processing of personal data in the third-party provider’s cloud. Ypsomed has no influence on the processing of these data.

You can stop the transfer of data at any time by cancelling the connection in your mylife account. Data thus far transferred to the third-party provider will remain stored there. If you wish to object to data processing by the third-party provider, please contact the third-party provider directly. Please refer to the data protection provisions of the third-party provider.

6. Protection and Storage of Personal Data

We use the cloud services of Microsoft to process your personal data in the mylife Cloud. The exact storage and processing location of your data may vary depending on the jurisdiction as detailed in Sections 8 and 10. The data in the mylife Cloud are encrypted and only SINOVO system administrators have access to the server’s Cloud database.

Ypsomed takes all necessary and reasonable technical and organisational actions to ensure the security, integrity and availability of the data.

We will only retain your data for as long as is necessary for the purposes set out in these notes regarding Privacy Policy or legally permissible or required. Specifically, this shall be for the length of time your account is active in the mylife Cloud. You can cancel your mylife Cloud account at any time. However, Ypsomed and SINOVO are subject to various statutory retention and documentation obligations. Your personal data will be securely and irrevocably deleted and/or anonymised after cancellation of the mylife Cloud account as soon as these deadlines and obligations no longer apply.

If you do not actively use your mylife Cloud account for two years and we have had no relevant contact with you, we will delete your personal data from our systems unless we believe, in good faith, that we are required to retain them in accordance with law or other regulation (for example, due to a request in connection with a prospective legal dispute).

7. Forwarding of Personal Data to Third Parties

Ypsomed only passes on personal data on to third parties if this is required by law, or if this is necessary for market surveillance, or if you have consented to the transfer. Ypsomed remains responsible for the control and correct processing of the personal data, even if they are forwarded to companies of the Ypsomed Group or suppliers for the handling of business processes. We ensure that the companies of the Ypsomed Group comply with data protection regulations, and we also oblige our distribution partners as well as the suppliers commissioned by us, to respect data protection and data security and to only process such data as is necessary to fulfil their task.

Recipients may receive personal data under one of the following conditions:

If you contact Ypsomed, those employees within Ypsomed who need your personal data to fulfil the purposes stated in these notes on Privacy Policy will have access to them. For example, these may be customer service employees who process your enquiries and requests.
Service providers and processors engaged by Ypsomed, such as SINOVO or Microsoft, who are contractually obliged to comply with the data protection standards.
If required by law or contractual agreement in connection with the monitoring of medical devices.
If required by law or an authority, it is possible that Ypsomed may process and disclose your personal data without prior notice or consent. This may be due to a court order or other regulatory requirement.
If you have consented to it.

The mylife Diabetescare therapy management may possibly contain links to websites or applications of third parties. Any access to these linked websites and their use is not subject to these notes regarding the Privacy Policy, but to the privacy policies of the websites of these third parties. We disclaim any responsibility for the information practices of third-party websites.

8. Transfer of Personal Data to Other Countries

We operate in various countries throughout the world, including, but not limited to Switzerland, the European Economic Area (EEA), the United States, Canada, the United Kingdom, and Australia. You determine where your data is stored via the country selection in the registration process. It is therefore important that you select your country of residence correctly. If you have inadvertently have selected the wrong country, please terminate the registration process. You can no longer change the country once the registration process has been completed.

Please be aware that personal data we collect may be transferred and maintained outside your country, state, province, or other jurisdiction, or location where the privacy laws may not provide as much protection as those in your location, including the United States. In order to ensure that your personal data is protected properly in such cases, Ypsomed has set up lawful transfer mechanisms and appropriate security measures in accordance with the applicable legal requirements. Such safeguards include the requirement that such countries offer an adequate level of data protection according to authorities including, but not limited to, the Swiss Federal Data Protection and Information Commissioner (EDÖB) or the European Commission, or we ensure the security of your data with appropriate guarantees (e.g. Standard Contractual Clauses) as well as increased technical security measures. If you have any questions about the safeguards in place for these transfers, please contact us via our customer care in Section 9.

10. Country-specific Notes

Ypsomed endeavours to provide a complete and correct translation that corresponds to the respective national language. In the event of a conflict between the language versions, the English version shall apply.

10.1 Germany

Use as a computer-only version

People with diabetes can obtain the mylife Software free of charge using the order form. Medical professionals can order the mylife Software or a licence key for the mylife Cloud directly from Ypsomed.

To order the mylife Software, you must provide Ypsomed with some personal data: surname, first name, street, house number postal code, city, e-mail address (optional), as well as the devices that are to be connected and their serial number.

The personal data contained in this form are processed exclusively for the purpose of establishing and processing this order and fulfilling the contract.

10.2 France

We record the country of origin via the country selection in the registration process. It is therefore important that you also select France as your country of residence if you live in France. This determines where your data are stored. The data of a French citizen may only be stored and processed in the national territory of France. If you have inadvertently selected the wrong country, please terminate the registration process. You can no longer change the country once the registration process has been completed.

In some cases, we request information about your profession in order to display specific content intended for you. If required by law, we will check your information before we send you the access data.

10.3 Canada

10.3.1 Requesting Detailed Information

If you are based in Canada and would like more detailed information about our privacy policies, standards, or codes, you can request a brochure or other explanatory materials. These materials are available upon request and provide a comprehensive overview of how we collect, use, and protect your personal data. To request these materials, please contact us directly via our customer care in Section 9 .

10.3.2 Note on Available Products and Services

The stipulations made in this privacy policy only apply insofar as a product is approved by Canadian authorities for marketing and available. Specifically, that means that Sections 3.2 “The mylife App” and 3.3 “The mylife Software (PC)” do not apply in Canada.

10.3.3 Data Storage Location

We record the country of origin via the country selection in the registration process. It is therefore important that you also select Canada as your country of residence if you live in Canada. This determines where your data are stored. The data of a Canadian citizen may only be stored and processed in the national territory of Canada. 11. Children

The mylife Cloud offer is aimed exclusively at persons of legal age. Persons under 18 years of age are expressly advised that they must obtain the consent of their parents or legal guardian to transfer their personal data.

If data have been transmitted to us by persons under 18 years of age without the consent of their parents or legal guardians, you shall have the opportunity to viewing the information provided by the underage person and/or to request correction or deletion thereof at any time. The provisions contained in these notes regarding the Privacy Policy apply until the request for correction or deletion of personal data is made.

12. Your Rights

Depending on your jurisdiction, you may possess different rights with regards to the data we store and process.

For clarification, Data Processing for users within the EU is subject to the General Data Protection Regulation (GDPR) as well as country-specific regulations. Users in Canada and the UK are entitled to equivalent treatment and are subject to rights indicated by the respective jurisdiction. Please see Section 10 Country-specific Notes for further information.

The general principles for all users of our products and services are set out below:

Object to the processing of your personal data

You have the right to object at any time to our processing of your personal data. However, if you object to processing, this make it impossible for us to provide you with any services or products.

Request access to your personal data and obtain a copy of your personal data

You have the right to request access to the personal data we hold about you and to obtain a copy of it. This allows you to understand how we process your data and verify that we are doing so lawfully.

Request correction of your personal data should your personal data be inaccurate, incomplete, or obsolete

You have the right to request the correction of any inaccurate, incomplete, or outdated personal data we hold about you. This helps ensure that your information is accurate and up-to-date.

Request erasure/deletion of your personal data

You have the right to request the erasure or deletion of your personal data. This right applies in certain circumstances, such as when the data is no longer necessary for the purposes for which it was collected or if you withdraw your consent.

Withdraw your consent to future processing where we have processed personal data based on your consent

You have the right to revoke any declarations of consent submitted to Ypsomed for the processing of personal data at any time, without giving a reason and either individually or collectively. The processing of the data remains lawful until such consent is revoked. You can exercise this right by sending us your revocation request in writing, e.g., by email. If you wish to revoke consent to the processing of data in the mylife Cloud specifically, you can simply cancel your account. Please note that after revoking consent, use of mylife therapy management is no longer possible.

Complain to a supervisory authority if you believe that our processing of your personal data infringes applicable data protection laws.

If you have doubts about whether your data are being processed in accordance with the law, you may be able to lodge a complaint with the supervisory authority responsible for data protection at your place of residence, employment, or at our registered office.

Depending on your jurisdiction, you may have additional rights:

Request restrictions on the processing of your personal data

You may have the right to request that we restrict the processing of your personal data. This means that we may store your data but will not process it further without your consent, except as permitted by law.

Request the transfer of your personal data to yourself or a third party

You may have the right to receive your personal data in a structured, commonly used, and machine-readable format and, where technically feasible and reasonable, to transmit these data to another controller without hindrance. This right to data portability typically extends only to the personal data.

To exercise a right to which you believe you may be entitled to under applicable law you can contact us directly us via our customer care in Section 9 . We may need to verify your identity before we fulfil your request or, under applicable law, we may be unable to take action with regard to your submission. We shall notify you in a timely manner of such decisions or requirements as required by law.

13. Changes to These Notes Regarding the Privacy Policy

The content of this data protection notice must be adapted from time to time. We reserve the right to make changes hereto at any time. Please consult the notes regarding the Privacy Policy regularly if you use the mylife Diabetescare therapy management. The current version is: 2.0 as of December 1^st 2024.
